These Terms of Service ("Terms") govern your use of the Tenvale property-management platform at tenvale.com, operated by Tenvale LLC ("Tenvale," "we," "us"). By creating an account or using the service, you agree to these Terms.
1. The service
Tenvale provides a software platform for independent landlords and small property managers to track properties, units, leases, tenants, rent collection, expenses, and maintenance. Tenvale is not a property-management company; we provide software you use to manage your own portfolio.
2. Eligibility and accounts
- You must be 18 years of age or older to use Tenvale.
- You must provide accurate registration information and keep it current.
- One account per legal entity. Multiple users within one organization may be invited as team members.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. Subscription, billing, and trial
- Subscription fee: $29.99 per month, recurring, billed in advance.
- Free trial: New accounts receive a 30-day free trial with full feature access, subject to a hard limit of 100 units and abuse-prevention limits. No credit card is required to start the trial. After the 30-day trial, a paid subscription is required to add additional units or to use paid-tier features; existing data and views remain accessible.
- Cancellation: You may cancel at any time through the in-product Customer Portal. Cancellation takes effect at the end of the current billing period. We do not pro-rate refunds for partial months.
- Payment processor: Subscription payments are processed by Stripe under Stripe’s terms.
- Tenant payments: When you collect rent from your tenants through Tenvale, those payments are processed by Stripe Connect. Stripe’s processing fees (currently 0.8% capped at $5 for ACH; 2.9% plus $0.30 for card) are deducted from your Stripe payout; tenants pay only the rent amount.
- Failed payments: If your subscription payment fails, we may suspend access until the failure is resolved. Operational data is retained during the suspension period.
4. Acceptable use
You agree not to:
- Use Tenvale for any unlawful purpose, including discriminatory tenant screening or selection that violates fair-housing laws.
- Attempt to scrape, reverse-engineer, or programmatically extract data from Tenvale beyond what our published APIs provide.
- Interfere with the operation of the platform or attempt to gain unauthorized access to systems or accounts that are not yours.
- Send communications through Tenvale (including via the email and SMS features) that are unlawful, fraudulent, harassing, or that violate the CAN-SPAM Act, the Telephone Consumer Protection Act, or applicable state marketing-communications laws.
We may suspend or terminate your account for material violations of this section.
5. Your data
You retain ownership of the data you submit to Tenvale (your properties, your leases, your tenants’ information you have authority to manage). You grant Tenvale a non-exclusive, worldwide license to use that data solely to operate the platform for you and to provide the services you have signed up for.
You are responsible for ensuring that you have the legal right to submit tenant and property data to Tenvale and for handling that data in compliance with applicable law.
6. Tenvale’s data
The Tenvale platform, software, design, brand, and documentation are owned by Tenvale LLC. These Terms do not transfer any ownership of the platform itself to you.
7. Privacy
Our handling of personal information is described in our Privacy Policy.
8. Disclaimer of warranties
Tenvale is provided "as is" and "as available." We make no warranties, express or implied, about the platform, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
Tenvale is software for record-keeping and operational tracking. It is not a substitute for legal, accounting, or compliance advice. Statutory deadlines (security-deposit interest, late-fee rules, eviction notices, etc.) remain your responsibility regardless of how the software is configured.
9. Limitation of liability
To the maximum extent permitted by law, Tenvale’s total liability for any claim arising out of or relating to these Terms or your use of the platform will not exceed the amount you paid Tenvale in the twelve months preceding the event giving rise to the claim. Neither party will be liable for indirect, incidental, consequential, special, or punitive damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless Tenvale LLC from and against any claims, damages, or expenses (including reasonable attorney’s fees) arising from your violation of these Terms, your unlawful use of the platform, or the data you submit to the platform.
11. Termination
- By you: Cancel anytime through the Customer Portal.
- By us: We may suspend or terminate your account for material breach of these Terms, suspected fraud, or non-payment, with notice where reasonably possible.
- Effect of termination: Access to the platform ends. Operational data is retained per our Privacy Policy data-retention terms.
12. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Massachusetts, and both parties consent to that venue.
13. Changes
We may update these Terms from time to time. For material changes, we will notify account holders by email at least 30 days before the change takes effect. Continued use after the effective date constitutes acceptance.
14. Entire agreement; severability
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Tenvale concerning the platform and supersede any prior agreements on the same subject. If any provision of these Terms is held unenforceable, the remainder remains in full force.
